These Terms & Conditions ("Terms") govern access to and use of the website located at cubexlabs.online and the software products made available through it (together, the "Service"), operated by Mohammed Salim Oussaine, trading as CubeXLabs ("CubeXLabs", "we", "us", or "our").
By creating an account, subscribing to a plan, or otherwise using the Service, you ("you" or "the User") agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
CubeXLabs provides AI-assisted software tools for early-stage founders and startup teams, including the PMF Navigator, MVP Builder, and Sales & Traction Agent, individually or together as the All-Access Bundle (each a "Product"). Each Product uses artificial intelligence, including third-party AI models, to generate analysis, recommendations, plans, and other content ("Outputs") based on information you provide.
2. AI-Generated Content: Please Read Carefully
Outputs are AI-generated and provided for informational and planning purposes only. They do not constitute professional, legal, financial, tax, or investment advice, and CubeXLabs does not guarantee their accuracy, completeness, or suitability for any particular purpose. You are solely responsible for evaluating and validating any Output before relying on it or acting on it in your business.
3. Eligibility and Accounts
You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@cubexlabs.online if you suspect unauthorized use of your account.
4. Subscriptions, Billing & Payment
Products are offered on a recurring subscription basis, billed monthly in advance unless otherwise stated at checkout. By subscribing, you authorize recurring charges to your chosen payment method until you cancel.
Payments are processed by our appointed payment provider, acting as merchant of record for the transaction. That provider handles payment collection, applicable sales tax/VAT, and related compliance on our behalf; your payment details are held by them, not by CubeXLabs directly.
We may change subscription pricing from time to time. Where a price change affects an active subscription, we will provide reasonable advance notice before it takes effect on your next billing cycle.
5. Cancellation
You may cancel your subscription at any time from your account settings or by contacting support@cubexlabs.online. Cancellation stops future billing; it does not automatically refund the current billing period. Access to paid features continues until the end of the billing period already paid for.
6. Refunds
Refunds are handled under our separate Refund Policy, which forms part of these Terms.
7. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse-engineer, disrupt, or gain unauthorized access to the Service or its underlying systems; (c) use the Service to generate content that is fraudulent, infringing, or harmful to third parties; or (d) resell or sublicense the Service without our prior written consent.
8. Intellectual Property
CubeXLabs retains all rights, title, and interest in and to the Service, including its software, design, and underlying technology. As between you and CubeXLabs, you retain ownership of the information and content you submit to the Service ("Inputs"). You grant CubeXLabs a limited license to process your Inputs solely to provide the Service to you, including through third-party AI providers as described in our Privacy Policy.
9. Third-Party Services
The Service relies on third-party infrastructure, including AI model providers and payment processors, to operate. We are not responsible for outages, errors, or changes originating from those third parties, though we will work to minimize any impact on you.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that Outputs will meet your expectations or objectives.
11. Limitation of Liability
To the maximum extent permitted by law, CubeXLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from your use of the Service. Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the three (3) months preceding the claim.
12. Termination
We may suspend or terminate your access to the Service if you breach these Terms, misuse the Service, or fail to pay applicable fees. Upon termination, your right to use the Service ceases immediately; provisions of these Terms that by their nature should survive termination will survive.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or a notice on the Service) before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of Morocco, without regard to conflict-of-law principles, except to the extent mandatory consumer protection laws of your country of residence apply and cannot be excluded.
